Terms of Service

These Terms summarize certain rules that apply to use of Litmus. Company customers are also subject to the full Litmus Terms of Service accepted through the platform or in an applicable order form. Candidates are also subject to the Candidate Platform Agreement accepted before accessing assessment content. Where these Terms and an agreement you've separately accepted conflict, the separately accepted agreement governs your use of the applicable feature.

1. Acceptance of Terms

By accessing or using Litmus ("Service"), operated by Litmus ("we", "us", or "our"), you agree to these Terms to the extent applicable to your use. Certain users, including candidates and company customers, may be required to accept additional or updated terms through the Service before accessing particular features, assessments, candidate submissions, paid plans, or company settings. If you do not agree, do not use the Service.

2. Description of Service

Litmus provides a platform for companies to create, manage, and evaluate technical assessments for engineering candidates. Candidates use the platform to receive and submit take-home assessments.

3. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to use the Service.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Submit fraudulent, impersonated, or unauthorized assessment responses, including responses completed by another person or generated using tools or materials in violation of the Candidate Platform Agreement or applicable assessment instructions
  • Attempt to gain unauthorized access to other accounts or systems
  • Interfere with the proper functioning of the Service
  • Scrape, copy, or redistribute content from the Service without permission

5. Intellectual Property

Companies retain ownership of assessment content they create. As described in the Candidate Platform Agreement accepted by candidates before accessing assessment content and submitting assessment work, Litmus owns the candidate's rights in the specific expression embodied in each submission upon submission, subject to exclusions for the candidate's pre-existing background materials, third-party and open-source materials, general skills and know-how, independently developed materials, and rights that cannot be assigned. Litmus licenses each submission to the inviting company for evaluation and hiring-decision purposes. Litmus retains ownership of the platform, its design, and underlying technology.

6. Payment and Billing

Paid plans are billed in advance on a recurring basis. You authorize us to charge your payment method on file. You may cancel at any time, but refunds are not provided for partial billing periods.

7. Termination

We may suspend or terminate your access at any time for violation of these terms. You may delete your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately. Account deletion does not affect rights, licenses, assignments, confidentiality obligations, records, or data retention that survive under applicable agreements, our Privacy Policy, or applicable law.

8. Disclaimers

The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

9. Limitation of Liability

To the maximum extent permitted by law, Litmus shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

10. Changes to Terms

We may update these terms from time to time. Where required by law or where we make material changes that require affirmative acceptance, we may ask you to review and accept the updated terms before continuing to use the relevant part of the Service. Continued use after changes may otherwise constitute acceptance of the revised terms.
